ABATE of FL's Stiffer Penalties Bill Passes 1st Committee

Tallahassee, FL January 27, 2012 - ABATE of Florida, Inc.'s Stiffer Penalties Bill, Senate Bill 1754, has passed it's first committee today. The Senate Transportation Committee passed the Bill with 7 yes votes and zero no votes. Doc, ABATE of Florida's Lobbiest, spoke before the committee during the hearing and said there no negative comments.

Senator Evers Files ABATE of FL's Stiffer Penalties Bill

Tallahassee, FL, January 11, 2012 - Senator Greg Evers has filed FL Senate Bill 1754 "Traffic Offenses", on behalf of ABATE of Florida, Inc. This Bill is designed to require penalties more severe than the $166 some drivers have faced after hitting and killing motorcyclists. The text of the Bill as submitted in original form reads:

"Traffic Offenses; Providing criminal penalties for a person who commits a moving violation that causes serious bodily injury to, or causes or contributes to the death of, a pedestrian or a person operating or riding in a motor vehicle or operating or riding on a motorcycle or bicycle; requiring that the person pay a specified fine, serve a minimum period of incarceration, and attend a driver improvement course; requiring that the court revoke the person's driver license for a minimum specified period; providing that the act does not prohibit the person from being charged with, convicted of, or punished for any other violation of law, etc."

ABATE of Florida is asking concerned citizens and motorcyclists to contact their local Senators and ask they support Senate Bill 1754. FEDERAL HELMET LEGISLATION NARROWLY AVERTED

Due to the quick actions of concerned motorcyclists across the country, a major federal transportation measure narrowly avoided becoming a bill to encourage states to enact helmet laws nationwide.

On Monday, December 12 Senator Frank Lautenberg (D-NJ) filed an amendment to S.1449 the "Motor Vehicle and Highway Safety Improvement Act of 2011" that would call for mandatory helmet laws nationwide and could jeopardize funding for Motorcycle Safety programs across America.

By Tuesday the motorcycle community was alerted to Lautenburg's efforts by national and state motorcyclists' rights organizations, including the National Coalition of Motorcyclists (NCOM) and numerous NCOM Member Groups, and riders were urgently urged to contact their U.S. Senators to oppose the amendment -- and time was of the essence because a Senate committee was to vote on the bill the following day!

Wednesday, Dec 14, during the hearing held by the U.S. Senate Commerce, Science & Transportation Committee to "mark-up" the bill, Senator Lautenburg decided not to introduce his amendment.

Not only did motorcyclists' prompt response help avoid another federal helmet law battle and preserve federal funding for motorcycle safety programs, but the committee also voted to accept two amendments by Senator Jim DeMint (R-SC) that removed language in the bill that would have lifted the current ban on the National Highway Traffic Safety Administration (NHTSA) from lobbying states to enact universal helmet laws for all riders.

S.1449 passed the committee by voice vote and now goes to the Senate floor for further action, while riders remain ever vigilant.

JUDGE UPHOLDS N.Y. MOTORCYCLE-ONLY CHECKPOINTS

A federal judge rejected motorcyclists' claims that their Constitutional rights were violated by New York State Police motorcycle-only "safety checkpoints" that detained thousands of riders en route to large N.Y. rallies and ticketed many of them for mostly non-safety violations.

Aid to Injured Motorcyclists (A.I.M.) Attorney Mitch Proner of NYC sued troopers on behalf of four motorcyclists who claimed that safety was a mere pretext in looking for criminals and that the practice was intrusive and unfair to motorcycle riders as a group.

But Judge Gary Sharpe concluded that safety was indeed the main focus of the initiative, which distinguishes the checkpoints from "a general interest in crime control" that could have amounted to unconstitutional seizures when there's no "individualized suspicion of wrongdoing."

"The court concludes the checkpoints were enacted to promote motorcycle safety, a manifest public interest; they were effective in addressing this interest; and that any interference with individual liberties was not only minimal, but also grossly outweighed by the interest advanced," Sharpe wrote in his ruling.

"The intrusion on civil liberties is something that shouldn't be countenanced," Proner told the Associated Press, adding that the discriminatory roadblocks have been ongoing since 2008 even though motorcycles, like other vehicles in New York, are already subject to annual safety inspections, and no other vehicles are stopped for roadside safety checks.

"It's obvious just from their own internal documents they're looking for criminal activity," said Attorney Proner, citing a checkpoint near Buffalo's Peace Bridge that included border patrol agents, and one in central New York near a rally sponsored by a motorcycle club included gang task force officers.

"The fact they didn't find crime doesn't mean that wasn't what they're fishing for," he said. "That just shows you've got law abiding citizens on motorcycles primarily being inconvenienced."

Proner told the AP news agency that motorcyclists across the country are interested in this case, the only such federal lawsuit nationally though some other states have similar checkpoint programs, and that he will appeal.

SAFETY BOARD SEEKS BAN ON CELL PHONE USE WHILE DRIVING

States should ban all driver use of cell phones and other portable electronic devices (PEDs), except in emergencies, urges the National Transportation Board. The NTSB recommendation, unanimously agreed to by the five-member board, applies to both hands-free and hand-held phones and significantly exceeds any existing state laws restricting texting and cellphone use by drivers.

The board made the safety recommendation in connection with their investigation of a deadly highway pileup in Missouri last year that was caused by the inattention of a 19 year-old-pickup driver who sent or received 11 texts in the 11 minutes immediately before the tragic crash that involved a semi and two school busses.

The accident is a "big red flag for all drivers," NTSB chairman Deborah Hersman said at a meeting to determine the cause of the accident and make safety recommendations. "No call, no text, no update is worth a human life."

The board has previously recommended bans on texting and cell phone use by commercial truck and bus drivers and beginning drivers, but it has stopped short of calling for a ban on the use of the devices by adults behind the wheel of passenger cars. While the NTSB doesn't have the power to impose restrictions, its recommendations carry significant weight with federal regulators and congressional and state lawmakers.

In November, Pennsylvania became the 35th state to forbid texting while driving, but despite such laws the problem is continuing to get worse according to the National Highway Traffic Safety Administration (NHTSA) that reports nearly 20% of drivers admit to texting or e-mailing, and at any given moment last year almost 1 in every 100 car drivers was texting, emailing, surfing the Web or otherwise using a handheld electronic device, up 50% over the previous year.

Joining in the campaign to curb distracted driving, Aid to Injured Motorcyclists (A.I.M.) has produced a color vinyl bumper sticker that reads; 'HANG UP AND DRIVE!" that is available free by calling A.I.M. at 1-(800) ON-A-BIKE.

US TRAFFIC DEATHS HIT LOWEST LEVEL SINCE 1949

Annual traffic deaths in the U.S. have fallen to their lowest level in six decades, reports the U.S. Department of Transportation. Despite the fact that Americans drove almost 46 billion more miles during the year, highway deaths fell by nearly a thousand to 32,885 in 2010, representing a 2.9% drop from 2009 (33,883) and the lowest number of fatalities since 1949.

While we have more work to do to continue to protect American motorists, these numbers show we're making historic progress when it comes to improving safety on our nation's roadways," said DOT Secretary Ray LaHood.

According to DOT statistics, deaths in crashes involving drunk drivers dropped 4.9% in 2010, resulting in 10,228 fatalities compared to 10,759 in 2009. Fatalities declined in most categories in 2010, including for occupants of passenger cars and light trucks, but fatalities rose among motorcycle riders (4,469 in 2009 to 4,502 in 2010, an increase of 33, or less than 1%), pedestrians (up 4% from 4,109 to 4,280), occupants in medium and heavy trucks (499 to 529, +6%) and buses (26 to 44, +41%).

The latest figures also include a new measure of fatalities caused by distracted driving, essentially a refinement of existing data that focuses more directly on situations where dialing a phone, sending a text or the activities of another person or event are likely to lead to a crash. The DOT reports that 3,092 fatalities were the result of such "distraction-affected crashes."

FEDS PROPOSE ADDITIONAL MOTORCYCLE SAFETY STUDY

The National Highway Traffic Safety Administration (NHTSA) is proposing to launch a study program equipping 160 motorcycle riders with cameras, GPS, and other data recording devices in order to track riding behavior and how riders avoid -- or fail to avoid -- crashes.

"Knowledge of both how riders successfully avoid crashes and of behaviors that correlate with and contribute to crash risk is crucial to developing effective countermeasures to reduce motorcycle crashes and fatalities," says the NHTSA study proposal.

The federal agency is currently seeking comments on their proposed motorcycle safety study, which is very similar to a "naturalistic study" being conducted by the Motorcycle Safety Foundation (MSF) tracking 100 specially-equipped motorcycles for one year to compile data on rider behavior.

NOISE CAMERA TO MUFFLE LOUD VEHICLES

First came red-light cameras, followed closely by speed-cameras, and now Calgary will soon become the first municipality to introduce noise cameras to the motoring public.

"Motorcycle riders and hotrod enthusiasts beware: the Noise Snare is one step closer to squelching your high-decibel expressions of mechanical masculinity," reported the Calgary Herald about the pilot project that pairs a noise-reader with a camera to catch law breakers.

The $112,500 device was offered to Calgary for free as the first city to test the gadget, and if all goes well the city expects to be handing out $200 tickets by summer.

"This is something that will allow municipalities across North America to start enforcing (noise) bylaws. The fact that now it's been proven to be an accurate test is very, very important," said Bill Bruce, the city's director of bylaw services.

Electrical engineer Mark Nesdoly invented the "Noise Snare" after a loud motorcycle awoke his sleeping daughter one night.

SHOOTINGS PROMPT HONDURAN CONGRESS TO BAN MOTORCYCLE PASSENGERS

Following two recent high-profile killings, legislators in Honduras approved a decree banning motorcyclists from carrying passengers. It took the deaths of a radio journalist and a former government advisor to convince the National Congress of the need to restrict the number of riders on a motorcycle to one -- the driver. Suspects in both cases were passengers on motorcycles, who got away.

The legislation is being hailed as a common sense approach to fighting crime that will help discourage drive-by shootings, which have been one of the most common murder tactics in this Central American country because it makes it nearly impossible to identify and catch the helmeted killers who quickly flee the crime scene. Now, any motorcycle with two people will be suspect and can be pulled over by the police.

NIGERIA RESTRICTS MOTORCYCLES TO CURB BOMBINGS

Restrictions have been imposed on the operations of commercial motorcycles in Nigeria to check bombing incidences. The restrictions on the motorcycles, popularly called okada, were announced by the Special Task Force (STF) after a deadly triple bomb blast rocked three television viewing centers was attributed to the Islamic sect Boko Haram.

"The general public should be informed that no motorcycle will be allowed to operate beyond 7pm within the Jos-Bukuru metropolis. Riding of motorcycles is only permitted from 6am - 7pm, the enforcement of this ban will be strictly enforced,'' said Ikemefuna Okafor, an officer of STF.

WEIRD NEWS: MOTORCYCLISTS TAKE BITE OUT OF SNAKE VENOM DEATHS

In rural Nepal, volunteer motorcyclists are getting snakebite victims to help soon enough to cut deaths by 95%, reports Scientific American.

Snake bites are still a big concern for much of the world's population, and the World Health Organization (WHO) estimates that about 100,000 people die from poisonous snakebites each year. Many more people become paralyzed or permanently disabled.

Most victims live too far from clinics that could provide them with anti-venom. In Nepal, where more than 10% of bite victims die, an experimental program uses volunteer motorcyclists to save residents. Since the program launched 2003, only about 5% of victims who got a ride died. These findings were presented at the annual meeting of the American Society of Tropical Medicine and Hygiene.

NTSB recommends ban on driver cell phone use

WASHINGTON (AP) — States should ban all driver use of cell phones and other portable electronic devices, except in emergencies, the National Transportation Board said Tuesday.

The recommendation, unanimously agreed to by the five-member board, applies to both hands-free and hand-held phones and significantly exceeds any existing state laws restricting texting and cellphone use behind the wheel.

The board made the recommendation in connection with a deadly highway pileup in Missouri last year. The board said the initial collision in the accident near Gray Summit, Mo., was caused by the inattention of a 19 year-old-pickup driver who sent or received 11 texts in the 11 minutes immediately before the crash.

The pickup, traveling at 55 mph, collided into the back of a tractor truck that had slowed for highway construction. The pickup was rear-ended by a school bus that overrode the smaller vehicle. A second school bus rammed into the back of the first bus.

The pickup driver and a 15-year-old student on one of the school buses were killed. Thirty-eight other people were injured in the Aug. 5, 2010, accident near Gray Summit, Mo.

About 50 students, mostly members of a high school band from St. James, Mo., were on the buses heading to the Six Flags St. Louis amusement park.

The accident is a "big red flag for all drivers," NTSB chairman Deborah Hersman said at a meeting to determine the cause of the accident and make safety recommendations.

It's not possible to know from cell phone records if the driver was typing, reaching for the phone or reading a text at the time of the crash, but it's clear he was manually, cognitively and visually distracted, she said.

"Driving was not his only priority," Hersman said. "No call, no text, no update is worth a human life."

The board is expected to recommend new restrictions on driver use of electronic devices behind the wheel. While the NTSB doesn't have the power to impose restrictions, it's recommendations carry significant weight with federal regulators and congressional and state lawmakers.

Missouri had a law banning drivers under 21 years old from texting while driving at the time of the crash, but wasn't aggressively enforcing the ban, board member Robert Sumwalt said.

"Without the enforcement, the laws don't mean a whole lot," he said.

Investigators are seeing texting, cell phone calls and other distracting behavior by operators in accidents across all modes of transportation with increasing frequency. It has become routine for investigators to immediately request the preservation of cell phone and texting records when they launch an investigation.

In the last few years the board has investigated a commuter rail accident that killed 25 people in California in which the train engineer was texting; a fatal marine accident in Philadelphia in which a tugboat pilot was talking on his cellphone and using a laptop; and a Northwest Airlines flight that flew more than 100 miles past its destination because both pilots were working on their laptops.

The problem of texting while driving is getting worse despite a rush by states to ban the practice, Transportation Secretary Ray LaHood said last week. In November, Pennsylvania became the 35th state to forbid texting while driving.

About two out of 10 American drivers overall — and half of drivers between 21 and 24 — say they've thumbed messages or emailed from the driver's seat, according to a survey of more than 6,000 drivers by the National Highway Traffic Safety Administration.

And what's more, many drivers don't think it's dangerous when they do it — only when others do, the survey found.

At any given moment last year on America's streets and highways, nearly 1 in every 100 car drivers was texting, emailing, surfing the Web or otherwise using a handheld electronic device, the safety administration said. And those activities spiked 50 percent over the previous year.

The agency takes an annual snapshot of drivers' behavior behind the wheel by staking out intersections to count people using cellphones and other devices, as well as other distracting behavior.

Driver distraction wasn't the only significant safety problem uncovered by NTSB's investigation of the Missouri accident. Investigators said they believe the pickup driver was suffering from fatigue that may have eroded his judgment at the time of the accident. He had an average of about five and a half hours of sleep a night in the days leading up to the accident and had had fewer than five hours of sleep the night before the accident, they said.

The pickup driver had no history of accidents or traffic violations, investigators said.

Investigators also found significant problems with the brakes of both school buses involved in the accident. A third school bus sent to a hospital after the accident to pick up students crashed in the hospital parking lot when that bus' brakes failed.

However, the brake problems didn't cause or contribute to the severity of the accident, investigators said.

Another issue involved the difficulty passengers had exiting the first school bus after the accident. The bus' front and rear bus doors were unusable after the accident — the front door because the front bus was on top of the tractor truck cab and too high off the ground, and the rear door because the front of the bus had intruded five feet into the rear of the first bus.

Passengers had to exit through an emergency window, but the raised latch on the window kept catching on clothing as students tried to escape, investigators said. Exiting was further slowed because the window design required one person to hold the window up in order for a second person to crawl through, they said.

It was critical for passengers to exit as quickly as possible because a large amount of fuel puddled underneath the bus was a serious fire hazard, investigators said.

"It could have been a much worse situation if there was a fire," Donald Karol, the NTSB's highway safety director, said.

National Call to Action: Federal Helmet Mandates

The Motorcycle Riders Foundation reports that the US Senate Committee on Commerce Science and Transportation will be marking up The Motor Vehicle Safety Act of 2011 (S. 1449). This bill governs the National Highway Transportation Safety Administrations activities. This bill has the potential to greatly affect motorcyclists nationwide.

There are three provisions that specifically target motorcyclists.

Call your Senators and ask them to:

Oppose Lautenberg amendment #1. This amendment would alter the motorcycle safety grant program by forcing states to pass mandatory universal helmet laws and drive federal tax dollars to be used to promote the use of helmets. This provision would make it easier for helmet law states to obtain 2010 grant money. This amendment would provide no money for awareness or training.

Support DeMint amendments #1 and #18. These amendments protect the NHTSA lobby ban. Under the proposed legislation are provisions to lift this lobby ban.

Support DeMint amendment #2. The bill, (S 1449) would change the definition of "motor vehicle equipment" to include motorcycle helmets. This would allow States to spend federal money dedicated to "motor vehicle equipment" on motorcycle helmets. The DeMint amendment would keep helmets out of that definition.

Protect Motorcycle Safety Grants and Fight Helmet Mandates with One Call	Take Action!
Call Your Senator on the Committee Immediately

On Wednesday, December 14, the Senate Commerce, Science, &Transportation Committee will mark-up the "Motor Vehicle and Highway Safety Improvement Act of 2011," (S. 1449). The measure covers the safety aspects of the next national transportation program, including the acceptable activities of the National Highway Transportation Safety Administration (NHTSA). S. 1449 contains three areas of critical concern to motorcyclists. The first is Lautenberg Amendment #1 filed on the morning of Monday, December 12. Senator Frank Lautenberg's (D-NJ) amendment would drastically alter the motorcyclist safety grant program, indirectly force states to pass mandatory universal helmet laws, and direct the use of federal tax dollars to only promote the use of helmets. More specifically, the amendment alters the current motorcyclist safety grant program (a.k.a. Section 2010 funds) by loosening the requirements to receive funds for states with mandatory universal helmet laws in place. A mandatory universal helmet law requires any rider and passenger on a motorcycle to be wearing a helmet at all times, regardless of age. The AMA believes that adults should have the right to voluntarily decide when to wear a helmet. States that currently do not have universal helmet laws would see their qualification criteria become stricter in order to receive safety grants. Additionally, states without mandatory universal helmet laws would be required to spend 50% of their grant funds on the promotion of helmet use. The remaining 50% could be spent on rider training, helmet promotion, enforcement programs to reduce impaired riding, linking motorcycle data together electronically in states, implementation of graduating licensing systems for riders, and speeding and reckless riding enforcement programs. The revised use of funds is contradictory to the spirit in which motorcyclists fought for the safety grant program during the last federal transportation initiative. In 2005, the motorcycling community came together to create the motorcyclist safety grant program to encourage states to fund motorcycle safety awareness, education, and training programs. The allowable uses of funds included public service announcements, motorist awareness campaigns, and the improved delivery of rider training. Lautenberg Amendment #1 would provide zero funding for awareness and education programs. The second threat to motorcyclists is a clause that would lift the ban on NHTSA being able to use federal tax dollars to lobby states to pass mandatory helmet laws. The provision was included in the national transportation program beginning in 1998 and was re-affirmed in 2005. The AMA believes that the decision on helmet laws is the right of each individual states and the federal government should not be allowed to apply unfair pressure to influence a state's choice on that issue. Senator Jim DeMint (R-SC) has introduced one amendment to strike the clause lifting the ban on NHTSA lobbying efforts. Additionally, DeMint has offered an amendment that would further address lobbying efforts by the federal government. Both DeMint Amendments #1 and #18 should pass in order to bar the federal government from using individual tax-payer dollars to control the state law-making process. Thirdly, S. 1449 seeks to alter the definition of "motor vehicle equipment" to specifically call-out motorcycle helmets. This is a tactic used to quietly suggest states spend federal funding related to any type of motor vehicle equipment on motorcycle helmets. Senator DeMint has also offered DeMint Amendment #2 to strike the reference to motorcycle helmets in this definition. FHP Seeking Help to Identify Driver Who Left Motorcyclist for Dead

Naples, FL, October 31, 2011- The Florida Highway Patrol has updated their description of the vehicle and driver sought for questioning regarding a hit & run crash that occurred October 25, 2011 shortly after midnight on Interstate 75 near mile maker 110 in Naples.

The driver of a 1990s to early 2000s two-tone white and brown or gold Ford F150 pickup truck was speeding south on I-75 when he rear-ended 62 year-old Henry Gacek, throwing him from his motorcycle. He was critically injured and may be paralyzed according to WINK-TV's interview of family members.

Witnesses say the truck drove away after the collision, heading southbound with smoke coming from its engine. State Troopers stated the truck may have damage to the right front headlight and grille area as well as possible radiator and engine damage as a result of this crash.

The driver was described as a 25-to-35-year-old male with black hair, a 5-o'clock shadow, an athletic build and white T-shirt.

Anyone with information about the identity of the vehicle or its driver is asked to contact Trooper Albert Gutierrez of the Florida Highway Patrol at (239) 938-1800.

Court Date Set for Killer of Motorcycle Passenger

Estero, FL - October 10, 2011 – Friday August 26, 2011 Doug McGill was riding his Yamaha motorcycle with his friend Janine Becker on the back. They stopped for the red traffic light after arriving at an intersection near the Coconut Point Mall. Stephen Alexander Brown pulled up behind them as the traffic light was changing from red to green, but instead of stopping, reports say he accelerated his Pontiac Grand Prix straight into the rear of McGill’s bike. After both were thrown from the bike, McGill was transported to the hospital with non-life threatening injuries. Janine Becker was pronounced dead at Gulf Coast Hospital.

Brown was cited for careless driving and driving a vehicle in an unsafe condition or with defective equipment. Since Janine Becker was killed in the crash, Brown will be required to appear before the Lee County Court on October 20, 2011. As of now, he only faces $267 in related fines. The Judge assigned to this case, the Honorable H. Andrew Swett, has the ability to impose additional penalties. However, even though it appears Brown was fully at fault in this fatal crash, he will not see any jail time for killing a motorcyclist. The current laws don’t call for incarceration in negligent driving cases such as this. Brown did get arrested for Possession of Marijuana back in June 2011; maybe that will send him to jail since killing a biker won’t.

FL Joint Legislative Auditing Committee Not Interested In 2nd Audit

Tallahassee, FL, October 5, 2011 – An Orlando, FL TV station publicly insinuated there were improprieties when there were none. A small group of motorcyclists with questionable motives babbled nonsense, and still they failed to get anyone riled up. Finally, after a Florida Joint Legislative Auditing Committee hearing Monday the truth was known to all once again; ABATE OF FLORIDA, INC. WAS IN FULL COMPLIANCE WITH THE STATE CONTRACT and DID NOTHING WRONG.

Florida State Representative Bryan Nelson (R- Apopka) called for the committee to audit ABATE of Florida regarding how we allocated the state funds for our Motorcycle Safety Awareness Program. He also asked why a specific vendor received a volume of the business from this contract, clearly trying to imply numerous improprieties. However, the other members of the Committee did not agree with Nelson, and a few stated that there had already been a state-funded audit which revealed the appropriated funds “were spent in a manner pursuant with the contract”. Additionally, ABATE of Florida State President James “Doc” Reichenbach, II testified that the specific vendor in question was a Florida-based minority vendor, one recommended to ABATE by the FL Department of Highway Safety and Motor Vehicles.

Next, Senate Minority Leader Maria Sachs (D-District 30) again questioned what triggered this interest in ABATE and the request for the additional audit. She’d heard there is a “disgruntled other organization” that is unhappy with ABATE and that since there was no proven evidence of misappropriation of state funds there is no need to spend additional state money by investigating this matter further.

Besides Rep. Nelson, the only other person present to testify in favor of spending additional state money by having a 2nd audit was “R.C.” Conroy. R.C. spoke of the 2004 Bill CS/CS/SB 682 as if it were current law. In fact, this Bill failed in committee over six years ago. Other interesting statements offered by R.C. included that Bikers of Lesser Tolerance’s (BOLT) purpose & mission is to “give up a little bit of safety to maintain your rights” as well as to “take various municipalities to court”. Besides his antagonistic statments, R.C. did not speak of any organization of which he is involved that educates the public to become more aware of the motorcycles sharing Florida’s roadways. Nor did he offer any method to improve motorcycle safety awareness in any way.

Representative Ken Roberson (R-Port Charlotte) further commented that in his area of Florida, ABATE of Florida is the organization that is promoting motorcycle safety.

Senator Evelyn Lynn (R-District 7) noted that it appears ABATE is interested in the greater safety of the motorcyclists. After hearing R.C. speak, Representative Nelson immediately withdrew his request for a second audit of ABATE of Florida, Inc.

Civic Leader Sentenced to 10+ Years for Killing Biker

Tavares, FL, September 30, 2011 – After changing his plea to “guilty” back on September 19th, former Public Defender Bruce Duncan was sentenced today to ten years and four months in a state prison, three years probation, a lifetime loss of his Drivers License, as well as a $5,000 fine. This sentence was received after Duncan got drunk and drove his truck into Herbert “Steve” Muller on October 17, 2009, killing Steve.

Duncan’s attorneys asked the court for a sentence of four years, the state’s minimum sentence according to the guidelines. The prison sentence Duncan received was the recommendation by the guidelines. “The fact that the Judge did not depart from Florida’s Sentencing Guidelines is a breath of fresh air” ABATE of Florida, Inc. State President, James “Doc” Reichenbach II stated today. “The defense had lined up a list of community leaders attempting to say Duncan was a great guy, and many were worried that Duncan wasn’t going to receive the punishment he deserved”.

Members from at least six ABATE of Florida chapters and other motorcyclists were present during many of the hearings, showing support for Steve Muller’s family and letting the public know that motorcyclists’ lives are worth more than a simple fine.

Civic Leader Changes His Plea to “Guilty”

Tavares, FL, September 20, 2011 – While riding back home from Biketoberfest on October 17, 2009, Herbert “Steve” Muller was hit and killed by Lake County civic leader Bruce Duncan. Duncan’s Blood Alcohol was twice the legal limit in addition to the ½ empty bottle of vodka FHP found in his truck. In court today, Duncan did not dispute these facts.

After many hearings in this case, on September 19 & 20, 2011 Mr. Duncan changed his plea to Guilty of DUI Manslaughter. This case took on a life of its own when Duncan’s defense team began lining up figures such as Florida State Representative H. Marlene O'Toole (R-Lady Lake), two Circuit Court Judges, President of Lake-Sumter Community College Dr. Charles Mojock, Tavares City Administrator John Drury, as well as fifteen other community leaders to be defense witnesses in Duncan’s hearing. Although there were several hours of testimony from family and friends on both sides, not all the defense witnesses had the opportunity to testify.

ABATE of Florida, Inc. State President, James “Doc” Reichenbach II, did testify for the prosecution, asking that the Court not depart from the recommended sentencing guidelines, and how drivers killing motorcyclists are getting away with insignificant fines. Asst. State Attorney Sue Purdy recommended that Circuit Judge Michael Takac impose a 12 ½ year prison sentence and a permanent license suspension. The state sentencing guidelines recommend a sentence of 10 years and a few months, but the defense attorneys have asked the Court to depart from these guidelines and sentence Duncan to only 4 years, the absolute minimum sentence allowed by law. The defense also motioned to suppress the testimony of “Doc” Reichenbach, claiming prejudice and that ABATE is not an affiliate. Judge Takac denied this motion, stating that he allowed numerous testimonies from defense witnesses that could very well be deemed prejudice as well.

On September 30, 2011 at 8:30 am Judge Takac will sentence Bruce Duncan at the Fifth Judicial Courthouse, Lake County, on 550 W Main St. Tavares, FL. Members from at least six ABATE of Florida chapters attended the Sept. 19th hearing. Motorcyclists are asked to show support for Steve Muller’s family and let the public know that we won’t stand idly by while we’re getting killed on Florida’s roadways.

PENNSYLVANIA MEASURE WOULD LIMIT LEARNER PERMITS

ABATE of Pennsylvania is supporting legislation to limit the number of motorcycle learner’s permits allowed before a rider must get a license. “All too often those involved in serious accidents have no motorcycle endorsement on their license,” lobbyist Charles Umbenhauer of BikePAC told the National Coalition of Motorcyclists (NCOM), adding that “In most cases this also means they have had no formal motorcycle rider training.”

State Representative Seth Grove (R-Dover Township) has introduced legislation aimed at increasing motorcycle safety by requiring riders to get a motorcycle license rather than continuously reapplying for a motorcycle learner's permit.

Currently, an aspiring rider can get a permit after passing a written test, which is good for a year to allow motorcyclists to legally ride and gain experience until they get their motorcycle license. However, some riders reapply to renew the permit year after year rather than getting a full license, Rep. Grove said.

Under Grove's proposal, a rider would only be allowed to reapply for a learner's permit three times in 10 years.

"The purpose is to make people get the license," stated Grove, adding that more motorcyclists taking the skills tests or enrolling in the state’s rider training program would mean more trained riders on the road.

If a rider doesn't get a license within 10 years of receiving the first permit, he or she wouldn't be able to get another permit for seven years. The bill was referred to the transportation committee earlier this year and is expected to be addressed this fall.

ILLINOIS GOVERNOR SEEKS CHANGES TO RED LIGHT BILL

Illinois motorcyclists who get stuck at red lights will remain stuck a while longer, as Governor Pat Quinn has vetoed legislation that would have made it legal to proceed through a red light that does not detect motorcycles.

However, the bill may yet become law if legislators agree to make some changes. Illinois has what is called an Amendatory Veto, wherein the governor can reject a bill as presented for signing, but with changes requested that, if met, will win his signature.

As written, House Bill 2860 sponsored by Senator Gary Forby (D-Benton) and Representative Daniel Beiser (D-Alton), specifies that motorcyclists could run red lights "after a reasonable period of time." Quinn objected that such wording is too subjective and “its interpretation could vary from individual to individual and county to county." He asked that the bill be changed to specify that the motorcyclist must wait two minutes. Quinn also asked for clarification that motorcyclists would still have to obey signs prohibiting right or left turns on red and would still have to yield to oncoming traffic.

ABATE of Illinois supported the measure when it passed the legislature in May, which is similar to laws enacted in 11 other states. “I was kind of disappointed with what the governor done,” said Sen. Forby. “ABATE’s going to have to make a decision on whether they want to negotiate with the governor’s office or try to override his veto.”

The Illinois Legislature has placed the amendatory veto on its calendar for action on October 19.

MOTORCYCLE-ONLY CHECKPOINTS CHALLENGED IN NEW YORK

On Monday, August 29, 2011, Robert "Prospector" Boellner, State Legislative Coordinator for ABATE of New York, Inc., and NCOM Region VIII Director, met with a representative from the New York State Attorney General's office to discuss the ongoing motorcycle-only vehicle checkpoints.

Since May 2008, ABATE has publicly expressed its opposition to New York State's tactic of conducting highway roadblocks which divert only motorcyclists from the state's roadways for the purpose of conducting "safety checks".

Because motorcycles operated in New York State are already required to pass annual safety inspections, the ongoing New York State Police initiative serves only to harass, intimidate and inconvenience motorcyclists traveling upon the state's roadways. Further, motorcycle-only roadblocks conducted in the name of "safety checks" are a discriminatory and unconstitutional infringement upon an individual's right to travel without interference, and an abuse of discretionary power as acknowledged by the New York State Court of Appeals.

The Office of the Attorney General was reportedly receptive to Prospector's request of an investigation into the actions of the New York State Police, and a reporting mechanism has now been implemented for direct complaints of motorcyclist profiling.

6 MILLIONTH MOTORCYCLIST GRADUATES FROM RIDER TRAINING

The Motorcycle Safety Foundation recently graduated its six millionth RiderCourse student, a milestone reached through the ongoing efforts of nearly 10,000 RiderCoaches at more than 2,000 training sites worldwide.

"We have RiderCourses across the nation and around the globe, often during weekdays, and virtually every weekend of the year," said Robert Gladden, vice president of the Motorcycle Safety Foundation, adding that a wide variety of MSF RiderCourses are available in every state to provide motorcyclists everywhere with lifelong learning opportunities.

"From the Basic RiderCourse to a much more advanced day on the track, from standard motorcycles to scooters to three-wheel motorcycles, from small bikes to large, we cover it all," said Dr. Ray Ochs, MSF director of training systems.

In addition, the MSF collaborates with safety professionals worldwide. For example, the MSF is currently helping establish rider training in the Hashemite Kingdom of Jordan. The MSF works with all branches of the U.S. Armed Services to support riders in the military. And the Foundation also works with world champion road racers on track-based programs that improve rider safety everywhere.

"The MSF is still best known for its world renowned Basic RiderCourse, the best first motorcycle ride for any new street rider and the cornerstone of the MSF’s Essential CORE curriculum," said Tim Buche, president of the MSF. "We want all riders to start with the BRC, then continue their education with the Basic Bike Bonding, Street RiderCourses and more."

FLORIDA COPS USE SECRET FILES ON BIKERS TO LOBBY AGAINST GUN LAW

Florida law-enforcement officials dipped into secret intelligence files to lobby against legislation that would have allowed holders of concealed-weapons permits to carry their guns openly. Newly released records show that a staff lobbyist for the Orange County Sheriff’s Office handed out restricted photos of bikers with valid concealed weapons permits to lawmakers as examples of the sort of people who might scare away tourists if they displayed their pistols.

"I actually stopped by every one of you guy's office this morning and dropped off … photographs of some biker outlaw gang guys that have concealed firearm permits. Those are the ones we're worried about carrying," sheriff's Capt. Mike Fewless told the state Senate Judiciary Committee on April 12, 2011. "Please defeat this terrible bill."

After the provision allowing open carry of firearms was removed from the bill, the state Senate voted against the measure, prompting accusations of fear-mongering by law-enforcement officials and raising concerns about police misuse of confidential files for political goals.

All together, Fewless obtained photographs and other information for 17 "outlaw bikers" from the Orange sheriff’s Intelligence Squad, an undercover unit that investigates "motorcycle gangs, white supremacy groups and organized crime,” specifically asking for pictures of "One Percenters", state attorney's records show. Seven of the eight photos of members of the Mongols, Outcasts, Outlaws, Pagans and Warlocks motorcycle clubs came originally from the state Driver and Vehicle Identification (DAVID) system, which Federal law classifies as “highly restricted personal information." None of the bikers had felony records and all were eligible for concealed-weapon permits recognized by Florida and 34 other states.

The motorcyclists are now represented by Aid to Injured Motorcyclists (A.I.M.) Attorney Jerry Theophilopoulos, who said he is planning to file a lawsuit against the sheriff’s office. "The only way to police the police when they break the law is to file a lawsuit, and we are prepared to get justice for all concealed weapon permit holders in this state," according to “Jerry T”, who serves as legal counsel for the Confederations of Clubs in Florida and advises ABATE of Florida on legal matters.

DRIVING WHILE BIKER

From the Gunny’s Sack, a monthly newsletter from Oregon A.I.M. Chief of Staff Gunny Hutcheson, members of the Henchmen MC have hired a lawyer to put the San Jose Police department on notice that harassment is not going to be tolerated without a fight.

They've filed an official complaint with the city's Office of the Independent Police Auditor alleging that the police are illegally profiling them, and the city's code enforcement unit is digging up zoning beefs to run them out of town. They say officers routinely pull them over, sometimes photographing their tattoos, based solely on their bad-boy reputations.

The Henchmen's complaint is not the first time a motorcycle club in San Jose has fought the law using the law. Five years ago, the Hells Angels won $1.8 million after suing police and sheriff's deputies for illegally raiding the club's headquarters and members' homes to link a bouncer, charged with killing a drunken bar patron, to the biker club. A jury acquitted the bouncer and a federal court sided with the Hells Angels.

“This kind of thing has come to a halt in Washington with their recent biker anti-profiling law, thanks to the Washington Confederation of Clubs and A.I.M. Attorney Marty Fox,” writes Gunny, “Fighting harassment by using a lawyer and the court system.”

Brothers and Sisters,

Since the birth of civilization man has been cynical and critical of those who look beyond the bounds of conventional thinking, whenever great things are imagined there are those who will immediately attempt to slander and disparage everything from concept to creation by saying “it will not work”. When the work of a person becomes the standard and recognition is widespread it becomes their reward for accomplishment, it also becomes a target for the spikes of an envious few. If your work is merely mediocre you will be left alone but if you achieve something great it will bring acclamation and the forked tongues of many will be wagging. Jealously does not protrude its forked tongue when someone does something commonplace, no one will strive to surpass or slander you until it is stamped as a masterpiece of great work or a great accomplishment has been achieved. Only then will those spiteful voices of the disappointed, envious few be heard crying out. Skepticism and suspicion will surely follow as punishment for accomplishment; emulation and envy are always at work for those who didn’t think of it first. Often, those who are in positions of authority who dismiss or ignore unconventional thinking receive credit for another person’s accomplishments, which only becomes an embarrassment to them for that person’s success.

We have been challenged and criticized for everything from promoting irresponsible legislation regarding giving motorcyclist the right to choose whether to wear a helmet or not to using tax payers dollars for motorcycle safety and being anti helmet. Can someone please explain how giving motorcyclists the right to choose and being anti helmet law can be misinterpreted? The fact is we have never been anti helmet and we don’t receive taxpayer’s money for motorcycle safety, we all pay to register our motorcycles. A portion of that money is allocated back to us through the state, approved by various committees passed through the House and the Senate and signed by the governor. The money we receive is paid for by every motorcyclist that registers his or her motorcycle. It is not to purchase trinkets it is used to pay for billboards, bumper stickers, printed information etc. and not least of all maintaining our position in Tallahassee.

Ask yourself this question. Do you honestly think the state of Florida would allocate a dime for motorcycle rights and safety with the current state of deficit, especially after ignoring our “Stiffer Penalty Bill” the past two or three years? Hey, be thankful that they voted for a “Ban on baggie pants” you how dangerous those can be…. We don’t want those uh, ahem youths to trip and conk their coconuts or get run over trying to hold them up while running through traffic now do we?

Let’s face it, the State of Florida doesn’t give a damn if we live or die, what makes anyone think for a split second that they are going to give ABATE of Florida $250,000 in taxpayers money on the threshold of an election year with a Billion Dollar plus deficit. But yet, a member of B.O.L.T., a former chapter president and the loser in a their run for ABATE of Florida, Inc. State President a few years ago and one of our own in a media edited blurb made that statement aired by channel 2 Orlando to make it look like it happened in Tallahassee. It didn’t happen in Tallahassee, Doc was confronted in Tallahassee. If you watch the clip it switches from using taxpayer’s money for motorcycle safety to an organization that is anti helmet in a 2 second flash of the message.

ABATE of Florida has worked virtually unsupported by the majority of the motorcycle community. Independents, riding associations and clubs alike have sat on the sidelines. The challenges we have overcome in the past 10 years include amending the helmet law giving us freedom of choice, when the insurance companies wanted to raise the mandatory $10,000 personal injury insurance rate to ride without a helmet to $50,000 ABATE was there to stop them, try fighting that without having representation. When the insurance companies realized they were beaten at their own game they tried to re- classify motorcycles as motor vehicles, which would have made it mandatory to insure your motorcycle with rates that would have made it financially impossible to maintain and ride legally, ABATE was there to stop them. When legislation was proposed to make it mandatory that all motorcyclists were to wear bright day-glo orange and green safety vests and motorcycles were to be painted in that same color scheme ABATE was there to stop them. When the fed’s proposed a mandatory national helmet law, ABATE was on the front line to stop them. When motorcycle only check points were being implemented nationwide ABATE was your front line of defense especially here in Florida the 4th largest MRO in the nation. When the feds and the EPA decided that no motorcycle exhaust system could be altered and only EPA approved stamped systems would be considered legal again, ABATE was on the front line to stop them. Lets not forget about amendments that were written when legislation was passed to impose $1,000 fines for vertical tags on motorcycles. ABATE is still the only MRO in the state that writes Bills and proposes legislation in behalf of all motorcyclist regardless what kind of motorcycle you ride. The list goes on and on and so do the challenges to our rights and freedoms as motorcyclists.

In closing, when I hear and see ABATE members being looked down on by MC’s and other riding organizations as second class citizens of the motorcycle community because we don’t have mandatory probate periods or other requirements to gain membership. I ask you this if you think things are bad now, try to imagine how bad it would be without ABATE standing up for your rights?

ABATE Chapters Help Build House for Wounded U.S. Veteran

St. Augustine, FL, August 25, 2011 – ABATE of Florida, Inc. Vintage Chapter members showed up in force last weekend to help build a new house for one of America's heroes. The home is being donated to Cpl. Tyler Southern and his wife by local businessmen in conjunction with Homes For OurTroops organization.

In 2010, Cpl. Southern, U.S. Marine Corps, lost both of his legs above the knees and his right arm above the elbow after stepping on a road side bomb while serving in Afghanistan.

Members of Vintage Chapter ABATE showed up and worked diligently alongside other local volunteers under the blazing sun to complete the shell of the new house in just three days. Chapter President John Massoth said the experience was very humbling. The designs for the new house were done by ABATE of Florida, Inc. Duval Chapter member Linda Purvis of Northeast Florida Design, Inc.

This is another example of ABATE chapters pulling together for a common goal and to honor and help one of our military veterans that have sacrificed a part of themselves so that we may enjoy our freedoms. KUDOS to all involved.

FL State Representative & Two Judges Helping Biker’s Killer

Lake County, FL, August 16, 2011 – The friends and family of Mount Dora, FL’s Herbert "Steve" Muller had to bear terrible news when learning that he had been killed in a crash. His death was a result of a crash allegedly caused by Lake County civic leader Bruce Duncan as Muller was riding his motorcycle back from Biketoberfest on October 17, 2009. The Florida Highway Patrol reported that Duncan was attempting to make a left turn, crossed into the motorcycle’s path, and hit the left side of Muller’s bike. FHP also reported finding a ½ empty bottle of vodka in Duncan’s truck as well as his Blood Alcohol Level being twice the legal limit.

Now, almost two years later, it seems that Muller’s friends and family have to bear even more distressing news, this time an obvious slap in the face. According to the Orlando Sentinel (8/7/11), Florida State Representative H. Marlene O'Toole (R-Lady Lake), Circuit Judges G. Richard Singeltary and T. Michael Johnson, President of Lake-Sumter Community College Dr. Charles Mojock, Tavares City Administrator John Drury, Executive Director of Lake EMS Jim Judge and fourteen other community leaders are listed as defense witnesses in the upcoming hearing.

After not being able to previously reach a plea agreement in his DUI Manslaughter case, it is believed that Duncan will plead “No Contest” or “Guilty” at the hearing. His attorneys will most likely then have all 20 witnesses speak on behalf of Duncan’s character. Their goal would be to show that the fatal crash was "an isolated incident for which [Duncan] has shown remorse" and ask the judge to impose a sentence more lenient than established state sentencing guidelines which call for 9 ½ to 15 years for allegedly taking Mullen’s life.

Being one of the top Motorcyclists’ Rights Organizations, ABATE of Florida feels the pending testimony by these elected and appointed officials is nothing other than a total abuse of their positions. Members of Florida’s Legislature, judges, town officials, and other government officials are all put into their occupations to work in the best interest of taxpayers, not to defend the actions of a personal friend that got drunk, made the wrong decision to drive his truck, and allegedly cause a crash that killed a biker.

ABATE of Florida, Inc.’s Lake County Chapter will be at this Sentencing Hearing in mass. The hearing will be held September 19, 2011 8:30 am at the 5th Judicial Circuit Court located at 550 W. Motorist Going to Court After Hitting Biker

Alachua County, FL, July 29, 2011 – On August 9, 2010, ABATE of Florida, Inc. Life Member Jeff Burrow was riding his Kawasaki Z1000 motorcycle through Alachua County, FL. He didn’t see the Hyundai Sonata cross into his path until it was too late. Amanda J. Skadhauge of Ocala, FL had decided to take a left turn, possibly not realizing that Jeff was already in the intersection. After landing a distance from the actual crash site, Jeff was transported to a Trauma Center to deal with the brain swelling, severe concussions, sprains, severe contusions in numerous places throughout his body, torn ligaments, and bruised organs. Three of the four days of his stay there the doctors kept him unconscious to help his body deal with the brain swelling.

Incredibly, Jeff Burrow survived this traumatic crash.

On Thursday, August 4, 2011 at 9 AM Ms. Skadhauge will be standing in front of the Court at the Alachua County Courthouse, Family and Civil Justice Center, Room 1A (201 East University Ave. Gainesville, Florida, 32601). She’s been cited with Failing to Yield to Oncoming Traffic (while taking a left turn) and currently faces a SIXTY-TWO DOLLAR FINE. To date, the court costs of $92 exceed the penalty, literally adding insult to the injury.

Motorcyclists and concerned citizenry are asked to attend this hearing on August 4, 2011 to let the Court know that the motorcyclists in Florida are paying attention to what happens in matters such as this, and that vehicle drivers must be reminded in every possible way to look out for the motorcycles sharing the Florida roadways. HOME OWNER & CONDOMINIUM OWNER ASSOCIATIONS AND MOTORCYCLES

July 13, 2011 - It has come to the attention of ABATE of Florida, Inc.'s State Board of Directors that some motorcyclists have encountered problems regarding parking and operating motorcycles within some deed restricted communities in Florida.

Please be advised that assuming the Home Owners/Condominium Owners Association's Governing Documents were created within Florida State Statutes, they carry legal weight and are enforceable in court. When purchasing a dwelling within a community or condominium that is run under an Association, make sure to read and understand the Documents related to the Association and your rights as a Property Owner under the Documents.

Florida law has specific time limits under which the Documents must be reviewed prior to a related property sale. You don't want to find out too late that you are not allowed a specific pet, more than a certain number of house guests at a time, a truck, a motorcycle, or the ability to rent your unit. These are common prohibitions in some Florida communities and condominiums. If you do not fully understand these documents or have any questions, you should consult an attorney.

Killer of Four Motorcyclists Going to Prison… For Life and Then Some

Sumter County, FL, July 7, 2011 – On March 13, 2010 Paul Sermons got drunk, got into his truck, and decided to drive down County Road 476 in Sumter County, FL. The traffic in front of him going slower than Sermons wanted, he began passing other vehicles. The two motorcycles coming in the other direction had no chance. Sermons hit both bikes ejecting all four riders; with one rider being launched into the windshield of the truck Sermons was passing. All the motorcyclists were killed.

On June 10, 2011, Sermons was found guilty of four counts of DUI Manslaughter and one count of driving on a suspended driver’s license. A few weeks later on July 6, 2011, the Honorable Judge Hallman had Sermons in his courtroom for the last time. By the time this final hearing was over, it was decided; Paul Sermons would never again walk as a free man. Not only did Judge Hallman sentence Sermons to life in prison, he sentenced Sermons to one life sentence for each of the four people he killed as well as pulling his driver’s license for life and many fines and fees.

ABATE of Florida members from many chapters were at every hearing throughout this case. Our members were there to offer support to the victims’ families from the beginning to the end of the hearings and trial. The Court recognized our presence from our members being in the courtroom to asking potential jurors if they were ABATE members. Although justice was finally served in this case, all must understand that in the end, there were no winners.
